This is a translation of our German T&C. Since this is just a laymans best effort and has not been checked by our lawyers, please take this as a general guideline. Legally binding are our German T&C.
If no other prior agreement has been taken, our prices are valid incl. VAT, ex works, without postage and packing. Shipments are made on buyers cost and risk. If not other agreement has been made, the sales price valid on the day of delivery is used.
A contract of sale is accomplished by sending a written purchase statement (EMail is sufficient) or by accepting the goods on delivery.
We reserve our rights of property of sold goods until complete payment of all outstanding debts.
For service and repairs only German law is applicable. Legal warranty claims are fulfilled either by mending or replacement at our choosing. Further claims (also on warranted attributes of the product) are excluded. If the mending of warranted goods fails repeatedly the customer has the right to choose between reduction of price, replacement of sold goods or redibitory action. Claims of defects must be made in writing, within 10 days.
Other indemnities against the consignee or his aides are excluded. This applies especially to consequential damages resulting from the purchase and use of goods sold by consignee.
We do not assume liability for damage to persons or damage or loss of property, resulting from usage, installation, de-installation or other application in conjunction with our products.
Returns of goods free of deficiency require our prior approval. Credit for returned goods are granted less a reasonable amount for reconstitution to a saleable state. Goods manufactured or acquired on customers order are exempt from returns and reimbursements, except for goods where we acknowledge a claim of defects.
Delivery of unfranked shipments will be rejected.
Please ask for a return material authorization (RMA) prior to return of products.
The German mail-order law (Fernabsatzgesetz) is only applicable to German residents.
Quotations are without obligation, error and omissions excepted, subject to changes without notice, subject to being unsold. Statements made in quotations are not to be considered as warranted characteristics in the sense of German Civil Code (BGB).
Should single aforementioned clauses not be valid or ineffective, the other clauses remain obliging. Further than the above clauses and statements the terms and condition of the 'ZVEI' (Zentralverband der Elektroindustrie) are applicable.
Place of fulfillment is Herxheim (Germany), place of jurisdiction is Landau (Germany); this also applies if the customer is not a registered commercial merchant and we claim our rights in a dunning procedure.
